English: Tán Tiêu Hội is a free-to-use Discord bot provided "as-is" with no warranties of any kind, expressed or implied. The developers expressly disclaim all liability for user conduct, illegal activities, content generated by users, or any damages arising from use or inability to use the Bot. Use of this Bot constitutes full and unconditional acceptance of all risks and all terms below.

1. Acceptance of Terms

By adding Tán Tiêu Hội ("the Bot") to a Discord server, interacting with any of its features, or using any service it provides, you ("the User") enter into a legally binding agreement with the development team of Tán Tiêu Hội ("we," "us," or "our").

These Terms of Service apply to:

Server administrators who authorize the Bot.
All end-users within any server where the Bot operates.
Any individual or automated process interacting with the Bot's features.

If you do not agree to these terms in full, you must immediately remove the Bot from all servers you administer and cease all interaction with it.

2. Eligibility, Age Restriction & Server Administrator Responsibility

You must be at least 13 years of age to use this Bot, consistent with Discord's own Terms of Service. By using the Bot, you represent and warrant that you meet this minimum age requirement.

If you are between the ages of 13 and 18 (or the age of majority in your jurisdiction), you represent that you have obtained parental or guardian consent to use the Bot and to agree to these Terms.

We reserve the right to immediately terminate access for any user we have reasonable grounds to believe is under the age of 13, without prior notice.

Server Administrator Responsibility

By adding the Bot to a Discord server you administer, you accept responsibility for ensuring that all members of your server comply with these Terms while using the Bot. You agree to:

Promptly remove the Bot if you become aware of systematic abuse within your community.
Not configure the Bot in ways designed to circumvent these Terms or Discord's Community Guidelines.
Cooperate with any reasonable request from us to investigate abuse reported within your server.

Server administrators are jointly liable for misuse that is knowingly facilitated or permitted through their server's configuration of the Bot.

3. Provision of Service

3.1 Availability

We reserve the right to modify, suspend, restrict, or permanently discontinue any feature, function, or the entire Bot at any time, with or without notice, and for any reason, including but not limited to maintenance, policy compliance, or cessation of the project. We shall not be liable for any interruption or discontinuation of service.

3.2 Free Service & No Warranty

This Bot is provided free of charge. No warranties, expressed or implied, are provided regarding uptime, data persistence, accuracy of outputs, or fitness for any particular purpose. We make no guarantee that the Bot will be error-free, uninterrupted, or free of harmful components.

3.3 Modifications to Terms

We may update these Terms at any time. Material changes will be announced in the Bot's official support server. Continued use of the Bot after any update constitutes acceptance of the revised Terms. If you do not agree to a revision, you must remove the Bot and cease all use.

4. Prohibited Conduct

You agree that you will not use the Bot, directly or indirectly, to:

Spam or flood commands, channels, or users in a manner that disrupts service.
Phish, scam, or deceive other users through Bot-facilitated interactions.
Scrape or harvest user data for any commercial, political, or unauthorized purpose.
Circumvent or exploit Discord's API rate limits, authentication, or security systems.
Distribute malware, self-bots, scripts, or any unauthorized automation targeting the Bot or Discord.
Harass, threaten, or abuse any person through Bot features.
Post or distribute illegal content, including but not limited to CSAM, content glorifying violence, or content that violates any applicable law.
Impersonate the Bot developers, Discord staff, or any other person or entity.
Reverse-engineer, decompile, or tamper with the Bot's code, systems, or infrastructure.
Use the Bot for any illegal purpose under the laws of Vietnam or your local jurisdiction.

Violation of any of the above may result in immediate and permanent termination of access without notice, and may be reported to Discord Trust & Safety or relevant law enforcement.

5. User-Generated Content (UGC)

The Bot may process, store, or display content submitted by users (e.g., custom messages, moderation notes, economy data). With respect to such content:

You retain ownership of content you create.
You grant us a worldwide, royalty-free, non-exclusive, sublicensable license to host, cache, process, and display such content solely for the purpose of operating the Bot within the Discord ecosystem.
You represent and warrant that any content you submit does not violate any applicable law, third-party intellectual property rights, or Discord's Community Guidelines.
We may remove any content at our sole discretion without prior notice if it violates these Terms or is otherwise deemed harmful.

6. Termination & Suspension

We reserve the right, at our sole discretion and without prior notice, to:

Suspend or permanently ban any user, server, or server administrator from accessing the Bot for any violation of these Terms or for conduct we deem harmful to the Bot, its users, or the broader community.
Remove the Bot from any server we determine to be in violation of these Terms or Discord's Community Guidelines.

Upon termination or suspension, your right to use the Bot ceases immediately. Provisions of these Terms that by their nature should survive termination (including Sections 7, 8, 9, 10, and 12) shall remain in full force and effect.

7. Absolute Limitation of Liability

To the maximum extent permitted by applicable law, the developers of Tán Tiêu Hội, their contributors, and affiliates shall not be liable for any:

Direct, indirect, incidental, special, consequential, or exemplary damages.
Loss of data, virtual currency, settings, server configurations, or server logs.
Damages arising from the use of, or inability to use, the Bot.
Actions taken by server administrators or moderators using the Bot's tools.
Conduct of any third party, including other users, in connection with the Bot.
Third-party service outages (e.g., Discord API downtime, AI provider outages) affecting Bot functionality.

This limitation applies regardless of the legal theory under which the claim is brought, and even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any cause of action shall not exceed USD $0, reflecting that this is a free service provided without any commercial consideration.

8. Indemnification

You agree to indemnify, defend, and hold harmless the developers of Tán Tiêu Hội and their contributors from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

Your violation of any provision of these Terms.
Your violation of any applicable law or regulation.
Your violation of Discord's Terms of Service or Community Guidelines.
Any content you submit, post, or transmit through the Bot.
Any harm you cause to another user through your use of the Bot.

This indemnification obligation shall survive termination of your use of the Bot.

9. Disclaimer of Warranties

THE BOT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT THE BOT WILL BE SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Force Majeure

We shall not be held liable for any failure or delay in performance of our obligations under these Terms arising from causes beyond our reasonable control, including but not limited to: Discord API changes or outages, acts of God, natural disasters, cyberattacks, government actions, internet service disruptions, or third-party service failures.

11. Intellectual Property

All code, logic, branding, and non-user-generated content associated with Tán Tiêu Hội is the intellectual property of its developers and is protected under applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Bot without explicit written permission from the developers.

12. Copyright & DMCA Infringement Reporting

If you believe that content processed or displayed by the Bot infringes your copyright or other intellectual property rights, please submit a written notice to us via the Bot's official support server containing:

Identification of the copyrighted work you claim has been infringed.
Identification of the material you claim is infringing and sufficient information to locate it.
Your contact information (name, address, email).
A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

We will review valid notices and take appropriate action, which may include removing the content in question. Repeat infringers may be permanently banned from using the Bot.

13. Dispute Resolution

In the event of any dispute, claim, or controversy arising from or relating to these Terms or the Bot:

Informal Resolution: You agree to first contact us through the Bot's official support server to attempt informal resolution. We will make a good-faith effort to resolve disputes within 30 days.
Governing Law: If informal resolution fails, the dispute shall be governed by the laws of Vietnam, and you consent to the exclusive jurisdiction of courts located in Vietnam.
No Class Actions: To the fullest extent permitted by law, you waive any right to bring claims as a plaintiff or class member in any class action, collective, or representative proceeding.

14. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. All remaining provisions shall continue in full force and effect.

15. No Waiver

Our failure to enforce any right or provision of these Terms at any time shall not constitute a waiver of that right or provision. Any waiver of any provision must be in writing and signed by an authorized representative of the development team.

16. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Socialist Republic of Vietnam, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the competent courts of Vietnam.

Users outside of Vietnam are solely responsible for compliance with any local laws applicable to their use of the Bot.

17. No Third-Party Beneficiaries

These Terms of Service are entered into solely between you and the developers of Tán Tiêu Hội. Nothing in these Terms, express or implied, is intended to or shall confer upon any other person or entity any legal or equitable right, benefit, or remedy of any nature whatsoever under or by reason of these Terms.

18. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and the developers of Tán Tiêu Hội with respect to your use of the Bot. They supersede all prior or contemporaneous communications, representations, or agreements — whether oral or written — relating to the Bot. In the event of any conflict between these Terms and our Privacy Policy, these Terms shall prevail with respect to matters of service use, and the Privacy Policy shall prevail with respect to matters of data processing.
